These are the Official Rules of the Giro Chasing Speed Facebook Contest (the “Contest”) sponsored by Giro® (the “Sponsor”). Details regarding entry and participation, winning selection, and prizes are contained in these Official Rules.
Timing: The Contest is open daily from 9:00 a.m. PDT on May 15, 2013 to 11:00 p.m. PDT on July 31, 2013 (the “Promotional Period”).
Eligibility: Except where prohibited by law, the Contest is open to all natural persons who are 14 years of age or older at time of entry. Employees of Easton-Bell Sports, Inc. or its affiliates, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees’ families (defined as parents, children, siblings, spouse, and life partners). Enter as often as you like. However, a single entrant can only win once weekly and one monthly prize throughout the duration of the Contest.
To Enter: The Contest may only be entered online. Contestants may enter the Contest online during the Promotional Period by logging on to http://www.facebook.com/girosportdesign (the “Contest Site”) and like the Contest Site. No purchase necessary. You can enter once a day.
Prizes: There will be a single Grand Prize package consisting of a Cervelo S5 bicycle, and a head to toe Giro outfit comprising a Giro Air Attack helmet, a pair of Giro shoes, and softgoods. Total value not to exceed $11,000.
Determination of Winners: A single winner will be drawn at random at the end of the promotional prize period. Odds of winning the grand prize depend on the number of eligible entrants.
Notification: The selected potential winners will be notified through a facebook message. At the sole discretion of Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: (1) potential winner’s failure to respond to mention within two (2) business days after its transmission; (2) the return of an email notification as undeliverable after three (3) attempts; (3) the return of the prize as undeliverable; (4) potential winner’s failure to provide Sponsor with satisfactory proof of age and identity; and (5) potential winner’s failure to execute and return an Affidavit of Eligibility/Release of Liability, Publicity and/or tax form within five (5) business days of notification. Upon disqualification of a potential winner, an alternate winner may be selected. Upon contacting potential winners and determining that they have met all eligibility requirements of the Contest, including without limitation the execution of required documents, such individuals will be declared “winners” of the Contest.
Except where otherwise expressly noted in these Official Rules, the selection of all prizes and products is subject to the Sponsor’s sole and absolute discretion. Prizes (and/or any portion thereof) are nontransferable and non-exchangeable. No refunds, substitutions or cash redemption of prizes are permitted except that Sponsor retains the right to substitute a prize of equal or greater retail value (or at Sponsor’s election, the approximate retail cash value of the applicable prize, as determined by Sponsor). Additional restrictions may apply.
All federal, state, provincial and local taxes related to each Prize are the sole responsibility of each Potential Winner. All other expenses and costs, not expressly listed above, including but not limited to any taxes, customs charges, and any other expense or cost, not expressly included above are the Potential Winner’s sole responsibility.
Use of Data: Sponsor may ask for personal data about entrants (including, without limitation, name, phone number, mailing address and e-mail address) when they enter the Contest online. Sponsor is entitled to use such personal data contained in all entry forms in accordance with Sponsor’s Privacy Policy at www.eastonbellsports.com, in particular, to contact a potential winner regarding a prize and for future marketing announcements to entrants from Sponsor via e-mail. By participating in the Contest, entrants hereby agree to all personal information uses and disclaimers as explained in Sponsor’s Privacy Policy.
Consent and Release: Entry and acceptance of prize constitutes permission for Sponsor and its affiliates to announce the winner’s name for promotional purposes without further compensation. By submission of an Entry and/or accepting any or all prizes, Contestant consents to such usage. By participating, Contestants agree to these Official Rules and to release, and indemnify and hold harmless Sponsor and its respective parent, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind, including death, arising from or in connection with the Contestant’s creation of any Entry, submission, or receipt or use and/or misuse of any prize, or Sponsor’s use of Contestants’ submission, name, likeness, or city and state of residence in any media for any commercial purpose whatsoever. Contestants assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or misuse of the prize. By participating, Contestants agree that any dispute related to this Contest shall be submitted exclusively to binding arbitration pursuant to the procedures of the American Arbitration Association. Any dispute resolution event requiring the physical presence of the parties shall occur in Los Angeles County, California and each participant waives any and all objections to jurisdiction and venue therein. By participating in this Contest, each Contestant understands and agrees to abide to these Official Rules and the decisions of Sponsor with respect to all aspects of the Contest, which are final and binding.
General: This Contest is governed by the laws of the state of California, and subject to all applicable international, federal, state and local laws and regulations, and is void where prohibited. Sponsor reserves the right at its sole discretion to cancel or modify the Contest if Sponsor determines that the Contest is impractical, fraudulent, void, unlawful, or if there are any technical or administrative malfunctions, errors, or other problems that affect the structure, terms or lawful administration of the Contest.
Online entries are deemed made by the authorized account holder of the Facebook account submitted at the time of entry. The “authorized account holder” is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted Facebook account. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder. Prizes will only be awarded to the authorized account holder.
If, in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering or electronic vote acquisition with or during any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, the Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process). In the event of such cancellation, Sponsor reserves the right to award prizes in a random drawing from all eligible entries received before the time of cancellation. Sponsor in no way promotes illegal acts, and any and all Entries that include or promote illegal acts shall be subject to disqualification.
Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, including http://www.eastonbellsports.com or any affiliated site thereof, or otherwise, including any injury or damage to Contestant’s or any other person’s computer related to or resulting from participation or downloading any materials in the Contest.
Should any provision of the Official Rules be or become invalid under the laws of a particular jurisdiction or country, such invalidity shall not affect the validity of the remaining provisions or valid operation in other jurisdictions or countries.
Facebook is not liable for any content posted by Sponsor or Contestants. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Contestants understand that they are providing information to Sponsor and not to Facebook. The information Contestants provide will only be used as described in these Official Rules. By entering, Contestants grant to Sponsor a free, perpetual, non-exclusive license to use their name, city and state of residence, testimonials, and/or prize information for advertising, publicity and promotional purposes in all media without further notice. By entering, each entrant acknowledges that Sponsor has the right at all times to disclose information (including the identity of the persons providing information or materials on the Contest Site) as necessary to satisfy any law, regulation or valid governmental request.
CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
